A prenuptial agreement, also called a premarital or antenuptial agreement, is a written contract made in contemplation of marriage between prospective spouses, setting forth, among other points, the rights each spouse will have to property brought into the marriage. A prenuptial agreement (commonly called a pre-nup) takes effect on marriage. To be upheld by the court, the contract must be fair and reasonable, and the parties must fully disclose their assets to each other. In many states, when an attorney drafts a prenuptial contract, each party must be represented by a separate attorney.

Thỏa thuận tiền hôn nhân là một hợp đồng bằng văn bản được lập dựa trên sự suy tính về hôn nhân giữa vợ/chồng trong tương lai, trong đó quy định các quyền mà vợ hoặc chồng sẽ có đối với tài sản được đưa vào cuộc hôn nhân. One attorney cannot represent both parties, because a prenuptial agreement is a contract, and a lawyer representing both sides to the same contract has a severe conflict-of-interest problem. For instance, suppose that the wife-to-be (the wealthier side of the relationship) hires her lawyer to represent her and her fiancé in drafting a prenuptial agreement. How would that lawyer protect the interests of the husband-to-be, while also protecting the interests of the one paying the legal bill?

- Prenuptial agreements = premarital = antenuptial agreement: a contract between two people who are about to marry regarding their respective property and support rights upon termination of the marriage by divorce or death, and sometimes regarding property rights during the marriage.
